License Agreement

This License Agreement is a binding contract between you and Fabtech Software Inc., the operator of colourise.com. Creating an account, uploading a file, or otherwise using the Colourise AI Photo processor — whether through a free daily quota or a paid lifetime plan — signals that you have read this Agreement and agree to every clause in it. If you do not, please close the tab and stop using the service.

Fabtech Software Inc. grants you a personal, revocable, non-exclusive and non-transferable right to use Colourise for your own photo editing purposes. You may not resell, sublicense, lease or share your plan with third parties; reverse engineer, decompile or otherwise attempt to recover the source code of any part of the service; operate Colourise as a white-label, timesharing or service-bureau offering; or use it in any way that this License does not expressly permit.

You remain responsible for everything you upload. By sending a file to Colourise you confirm that you either own the image or hold sufficient rights to process it, and that your intended use complies with copyright, privacy and publicity laws in your jurisdiction. You may not use the service to touch images that infringe the rights of others, or redistribute third-party content you processed here for a purpose the rights holder has not authorized.

Colourise is licensed, not sold. An active plan grants you permission to use the background removal and photo colorization engines for the duration of that plan — a free tier is available for occasional personal use with a daily quota, while paid lifetime access unlocks unrestricted day-to-day processing. You may not repackage Colourise into a competing product, aggregate its output as part of a paid dataset, or use the service as a stepping stone to train a competing model.

To the fullest extent permitted by the laws that apply to you, Fabtech Software Inc. shall not be liable — in contract, tort, statute or otherwise — for any indirect, incidental, consequential, special or punitive damages, nor for lost profits, lost business, lost data, lost files or any cost of procuring substitute services, even where we have been advised that such loss was possible. Nothing in this clause purports to exclude liability for death, personal injury, fraud or anything else that cannot lawfully be excluded.

If any provision of this License is found by a competent court to be unenforceable, that provision shall be modified only to the minimum extent necessary to be enforceable; the remaining provisions continue in full effect. This License may be amended only by a written instrument signed by an authorized officer of Fabtech Software Inc. Model upgrades, feature releases and operational changes to Colourise may be introduced at any time and may carry supplemental terms.

This License, together with any terms expressly incorporated by reference on colourise.com, constitutes the entire agreement between you and us regarding the service, and supersedes any prior conversation, advertising or assurance. You may not assign your rights under this License; Fabtech Software Inc. may freely assign or transfer its rights and obligations, including as part of a merger or sale of assets. The Colourise website, interface design, imagery, copy, source code and all related intellectual property are owned by Fabtech Software Inc. and protected by the copyright laws of Hong Kong and international treaties. Mirroring, scraping, re-publishing, framing or reusing any portion of the site without prior written authorization from Fabtech Software Inc. is prohibited, and Fabtech Software Inc. reserves all legal remedies, including injunctive relief and damages, against such conduct.
